General Terms and Conditions of Sale: The Scentorium Covenant

Welcome to Scentorium. In our gallery, we treat every transaction with the same precision and care as the creation of a fine extrait de parfum. The terms “we,” “us,” and “our” refer to RECHARGE CENTER S.R.L., the curator and operator of the Scentorium digital sanctuary.

These General Terms and Conditions (the “Terms of Service” or “Terms”) govern your relationship with our services. This contract is established in strict accordance with Romanian Law, including Law no. 365/2002 on electronic commerce and Government Emergency Ordinance no. 34/2014 (OUG 34/2014) on consumer rights in distance contracts. 

By interacting with our platform or acquiring a creation from our collections, you agree to be bound by these Terms and our [Privacy Policy].

SECTION 1. THE ART OF THE ORDER: ACCESS & ACQUISITION

1.1. Eligibility and Account Integrity By agreeing to these Terms, you represent that you have reached the age of majority in your jurisdiction. To access our bespoke services, you may be required to provide accurate and complete information, including digital coordinates and shipping details. You are responsible for maintaining the confidentiality of your account credentials.

1.2. Olfactory Representation (Art. 6 OUG 34/2014) We have made every effort to accurately represent our artisanal products through visual and narrative descriptions. However, as fragrance is a subjective and evolving medium, descriptions are subject to change without notice. We reserve the right to limit quantities or discontinue rare editions at our sole discretion.

1.3. The Offer to Purchase Placing an order constitutes a formal offer to purchase. Scentorium reserves the right to accept or decline any order. In the rare event of a cancellation or modification, our concierge will notify you via the email or phone number provided at checkout.

SECTION 2. FISCAL TRANSPARENCY & LOGISTICS

2.1. Pricing and Invoicing The price of each creation is established at the moment of the order and confirmed via email. Prices displayed in our gallery are inclusive of all applicable taxes (VAT), excluding shipping costs, which are calculated and displayed transparently at checkout.

2.2. Delivery Obligations (Art. 59 OUG 34/2014) Unless otherwise specified for limited pre-orders, we transfer physical possession of the goods without undue delay, and in any case, within a maximum of 30 calendar days from the conclusion of the contract.

2.3. International Commerce & Imports (Non-EU) As Scentorium curates global treasures (e.g., Byermia from Australia), the following fiscal rules apply:

• IOSS Regime (Value $\le$ 150 EUR): If the IOSS scheme is utilized, the price includes Romanian VAT; no additional duties apply upon delivery.

• Standard Import (Value > 150 EUR): For high-value items, the price excludes customs duties or import VAT. In these instances, the Buyer acts as the Importer of Record and is responsible for fees charged by the Romanian Customs Authority.

SECTION 3. THE DISCOVERY PERIOD & OLFACTORY INTEGRITY

3.1. The 14-Day Right of Withdrawal In accordance with EU regulations, you have a period of 14 calendar days to withdraw from this contract without justification, beginning from the day you acquire physical possession of the goods.

• Our Obligation: We will reimburse all payments received, including initial standard delivery costs, within 14 days of receiving your notification.

• Your Obligation: You must return the item within 14 days of your withdrawal notice and bear the direct costs of return shipping.

3.2. ⚠️ The Hygiene Exception (Art. 16 letter e, OUG 34/2014) Fragrance is an intimate personal care product. Under Romanian law, the right of withdrawal does NOT apply to sealed goods that are unsuitable for return due to health protection or hygiene reasons if they were unsealed by the consumer.

Definition of Unsealing: The removal, breaking, or deterioration of the original protective factory seal (cellophane wrap or security sticker) constitutes unsealing. Once unsealed, the product loses its eligibility for return. We strongly recommend testing our before opening full-sized flacons.

SECTION 4. AUTHENTICITY & INTELLECTUAL PROPERTY

4.1. The Guarantee of Provenance Scentorium guarantees that all perfumes in our gallery are 100% authentic and original, sourced exclusively through legal and authorized channels.

4.2. Intellectual Property Rights All content within the Scentorium sanctuary—including trademarks, narrative text, bespoke imagery, and site design—is protected under Romanian Law (Law 84/1998 and Law 8/1996) and European IP directives. Unauthorized use of our trademarks or creative assets is strictly prohibited. 

SECTION 5. DISPUTE RESOLUTION & LEGAL REMEDIES

5.1. Amicable Settlement We believe in the power of refined communication. Any dissatisfaction should first be addressed through our concierge for an amicable resolution.

5.2. Alternative Dispute Resolution (ADR/SAL) If an agreement cannot be reached, consumers may resort to Alternative Dispute Resolution procedures via the National Consumer Protection Authority (ANPC).

SECTION 6. SELLER IDENTIFICATION (LEGAL OBLIGATIONS)

Burden of Proof: The burden of proof regarding the fulfillment of all pre-contractual information requirements established by law rests exclusively with RECHARGE CENTER S.R.L. (Scentorium).⁵
