Preserving Olfactory Integrity: The Scentorium Return & Refund Policy

Governing Law: This policy is governed exclusively by Romanian law (including OUG 34/2014) and relevant European Union consumer protection directives.

At Scentorium, operated by RECHARGE CENTER S.R.L., we understand that fragrance is a deeply personal and sensory journey. However, because we curate highly sensitive, limited-batch olfactory art, we must maintain rigorous, uncompromising standards for returns. To ensure the absolute purity, provenance, and safety of every flacon in our collection, we operate under a highly restrictive return protocol.

By completing a purchase in our gallery, you explicitly acknowledge and agree to the following terms.

I. The "All Sales Are Final" Philosophy

Due to the exclusive and delicate nature of niche perfumery, Scentorium operates under a general All Sales Are Final philosophy. We do not offer full refunds, exchanges, or returns for "change of mind", subjective dislike of a fragrance's profile, or "buyer's remorse." Once an order is processed, immense resources are allocated to secure and package your artwork.

II. The Discovery Period (14-Day Right of Withdrawal for EU Residents)

In accordance with EU statutory rights, consumers have a 14-calendar-day window from the day of physical delivery to withdraw from the contract, provided the item remains completely untouched and factory-sealed. However, as agreed upon at checkout, authorizing a return for a non-defective, sealed item incurs strict administrative protocols:

  • No Outbound Shipping Refunds: We categorically will not refund the initial outbound shipping costs. The transit service has already been rendered.

  • Restocking Fee: Scentorium reserves the absolute right to retain an administrative and restocking fee of 5% to 10% of the product's value from your total refund. This covers the irreversible loss of bespoke packaging, logistical time, and the rigorous re-authentication process required for high-value items.

  • Return Shipping Costs: The consumer bears 100% of the direct costs and liability for returning the goods securely.

III. ⚠️ The Olfactory Integrity Clause (Absolute Hygiene Exception)

Fragrance is legally classified as an intimate personal care and hygiene product. Under Article 16, letter e) of OUG 34/2014, the right of withdrawal does NOT apply to the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed by the consumer.

  • What constitutes "unsealing"? The removal, cutting, or visible deterioration of the original factory protective seal (e.g., cellophane wrap, wax seal, or security sticker) instantly voids any eligibility for return.

  • The "First Spray" Clause: For artisanal flacons that do not utilize cellophane, our policy remains absolute. If there is any evidence that the atomizer pump has been primed, depressed, or that even a single micro-spray has been discharged, the artwork is irrevocably altered by oxygen exposure.

  • Finality: An opened, primed, or sprayed perfume cannot be resold under any circumstances and is considered a final, unreturnable sale.

IV. Conditions for a Valid Return (Sealed Items Only)

To be eligible for an authorized return and partial refund, the item must be returned in the exact, pristine condition it was dispatched:

  1. Factory-Sealed: Outer cellophane and security seals must be completely intact and untampered.

  2. Flawless Presentation: The original branded box must not be dented, scratched, or damaged during the return transit.

  3. Complete: The return must include any complimentary samples or gift-with-purchase items received. If samples are missing or used, their retail value will be deducted from the refund.

V. Return Procedure & Logistics

Do not ship items back without prior authorization. Unauthorized returns will be rejected at the facility.

  1. Notification: Contact our concierge at contact@scentorium.eu within 48 hours of delivery to initiate the request.

  2. Secure Transit: We demand the use of a tracked and insured premium courier service. Scentorium is not responsible for items lost, stolen, or damaged during return transit.

  3. Authorized Return Facility: All approved returns must be shipped to our operational logistics hub:

VI. Exceptions: Defective Goods or Transit Damage

A full refund—including the product cost and all associated shipping costs—is granted strictly and exclusively if the product arrives physically defective from the factory (e.g., shattered glass, leaking mechanism) or critically damaged during transit.

  • Any defect must be reported to contact@scentorium.eu within 48 hours of delivery, accompanied by clear photographic and video evidence of the parcel, the packaging, and the defect.

VII. International Customs Refusal (Non-EU)

If an international parcel is returned to us because the Buyer refused to pay local import duties, customs taxes, or failed to claim the package, Scentorium will issue a partial refund strictly reflecting the exact operational damages. We will deduct the original shipping cost, all return shipping/customs penalties levied against us, plus the 5% to 10% administrative fee.

VIII. Protection Against Return Abuse

We rigorously monitor our platform for return abuse, serial returning, and fraudulent purchasing patterns. Scentorium reserves the unconditional right to refuse service, cancel future orders, and ban accounts or locations that exhibit an unreasonable return history.
