Welcome to Scentorium. In our digital sanctuary, we treat every transaction with the same precision and care as the creation of a fine extrait de parfum. The terms “we,” “us,” and “our” refer to RECHARGE CENTER S.R.L., the curator and operator of the Scentorium gallery.

These General Terms and Conditions (the “Terms of Service” or “Terms”) govern your relationship with our services. This contract is established in strict accordance with Romanian Law, including Law no. 365/2002 on electronic commerce and Government Emergency Ordinance no. 34/2014 (OUG 34/2014) on consumer rights in distance contracts.

By interacting with our platform, ticking the consent box at checkout, or acquiring a creation from our collections, you explicitly acknowledge and agree to be bound by these Terms, our Return Policies, and our Privacy Policy.

SECTION 1. THE ART OF THE ORDER: ACCESS & ACQUISITION

1.1. Eligibility and Account Integrity By agreeing to these Terms, you represent that you have reached the age of majority in your jurisdiction. You are entirely responsible for providing accurate shipping coordinates and maintaining the confidentiality of your account credentials.

1.2. Olfactory Representation & Artisanal Variations We have made every effort to accurately represent our artisanal products through visual and narrative descriptions. However, as niche fragrance is a highly subjective, evolving medium containing high concentrations of natural absolutes, descriptions, juice colors, and subtle batch variations are entirely normal and subject to change without notice. Such artisanal variations do not constitute a "defect."

1.3. The Offer to Purchase & Right of Refusal Placing an order constitutes a formal offer to purchase. Scentorium reserves the absolute right to accept, decline, or cancel any order at our sole discretion, especially in cases of suspected fraud, return abuse, pricing errors, or inventory limitations.

SECTION 2. FISCAL TRANSPARENCY, LOGISTICS & INTERNATIONAL DUTIES

2.1. Pricing and Territorial VAT The prices displayed in our gallery are inclusive of Value Added Tax (VAT) only for orders shipped within the European Union (EU). For international orders shipped outside the EU, the displayed price is strictly for the artisanal product. Shipping costs are calculated transparently at checkout and cover only the transit of the parcel.

2.2. International Commerce & The Importer's Responsibility When acquiring a Scentorium creation from outside the European Union, you legally become the Importer of Record.

• Complete Fiscal Assumption: The Buyer is solely and completely responsible for bearing any and all customs duties, import taxes, local VAT, and courier brokerage fees required by their local government to clear the shipment.

• Unclaimed Parcels & Customs Refusal: If a Buyer refuses to pay the required local import duties or fails to claim the parcel, resulting in the shipment being returned to Scentorium, this is considered a critical breach of the purchase agreement.

2.3. Restocking Protocol for Refused International Orders In the event of a refused or unclaimed international delivery, Scentorium will issue a partial refund strictly reflecting the exact operational damages incurred. The refunded amount will be the original purchase price MINUS:

1. The original outbound shipping cost.

2. All return shipping costs, brokerage fees, or import taxes levied against Scentorium by the courier/customs.

3. A restorative administrative fee of 5% to 10% of the product's value to cover wasted premium packaging, operational labor, and transit risks.

SECTION 3. ACQUISITION FINALITY, RETURNS & THE REFUND POLICY

At Scentorium, we curate limited-edition, highly sensitive olfactory art. To maintain the pristine provenance of our gallery, we enforce a rigorous policy regarding order finality and returns.

3.1. "All Sales Are Final" Principle Due to the exclusive nature of niche perfumery, Scentorium operates under a general All Sales Are Final philosophy. We do not offer refunds or exchanges for "change of mind", subjective dislike of a fragrance (e.g., "it doesn't mix well with my skin chemistry"), or "buyer's remorse." Once an order is processed, immense resources are allocated to secure and package your artwork.

3.2. Exceptions for Defective Goods (Full Refund Guarantee) A full refund—including the product cost and all associated shipping costs—is granted strictly and exclusively if the product arrives physically defective from the factory (e.g., shattered glass, severely leaking mechanism) or critically damaged during transit.

• Procedure: Any defect must be reported to our concierge within 48 hours of delivery, accompanied by clear photographic and video evidence of the parcel and the defect.

3.3. Restocking & Administrative Fees for Standard Returns (Sealed Items Only) While we strongly discourage the return of non-defective items, if a return is legally authorized for a properly sealed product, Scentorium categorically will not refund the initial outbound shipping costs. Furthermore, the Buyer explicitly agrees that Scentorium reserves the right to retain an administrative and restocking fee of 5% to 10% from the product's value. This fee covers:

• The irreversible loss of bespoke, premium packaging materials.

• Operational time spent processing the initial order.

• The logistical risk of re-authenticating a highly sensitive item.

• Condition of Return: The sealed item must be returned in flawless condition. If the outer presentation box is dented, scratched, or damaged during the return transit, the return will be rejected. The Buyer is 100% responsible for organizing and paying the return shipping via a tracked and insured courier service.

3.4. ⚠️ The Absolute Hygiene Exception & The "First Spray" Clause (Unsealed & Tested Goods) Under European and Romanian law (Art. 16 letter e, OUG 34/2014), the right of withdrawal does NOT apply to goods unsealed by the consumer due to health protection and hygiene reasons.

• Zero Tolerance on Unsealing: The removal, cutting, or breaking of the original factory protective seal (cellophane wrap, wax seal, or security sticker) instantly and permanently voids any eligibility for return.

• The "First Spray" Clause: If a flacon lacks a traditional outer cellophane seal, our policy remains absolute. Any evidence that the atomizer pump has been primed, depressed, or that even a single micro-spray has been discharged, constitutes full consumption of the product's pristine integrity. Once the pump is primed, oxygen enters the flacon, irrevocably altering the artwork.

• Finality: An unsealed, primed, or sprayed fragrance cannot be returned, exchanged, or refunded under any circumstances, regardless of the reason or claims of "just one test spray."

SECTION 4. FAIR USE, RETURN ABUSE & THE RIGHT TO REFUSE SERVICE

4.1. Protection Against Return Abuse Scentorium curates rare, limited-batch olfactory art. The logistical process of securely shipping high-value items is immense. We rigorously monitor our platform for return abuse, serial returning, and fraudulent purchasing patterns.

4.2. Identifying Abusive Behavior We reserve the unconditional right to flag, restrict, or ban accounts, IP addresses, or delivery locations that exhibit an unreasonable return history. Abusive behavior includes placing bulk orders with the intent of returning them, or repeatedly ordering and returning sealed items.

4.3. The Scentorium Defense Protocol To protect the integrity of our gallery, if our security systems detect a pattern of abuse:

• Right to Cancel: Scentorium will unilaterally cancel and refund any future orders from the abusive party prior to dispatch.

• Enforcement of Penalties: In documented cases of serial returns or bulk order refusals, Scentorium classifies the action as a breach of good faith and will rigidly enforce the withholding of all shipping costs plus a 10%administrative fee from any resulting refunds.

SECTION 5. THE INTEGRITY OF THE ARTWORK & ANTI-DECANTING POLICY

5.1. The Sanctity of the Sealed Creation The fragrance within and the flacon that cradles it are inseparable elements of the creator's artwork. Breaking a factory seal to split, decant, or rebottle the fragrance destroys the integrity of the piece and severs its story.

5.2. Our Stance on Decanting Scentorium strongly condemns the practice of purchasing full bottles strictly to unseal, decant (resell by the milliliter), and discard the vessel. Exposure to oxygen, light, and non-sterile extraction tools irrevocably alters and corrupts the fragrance’s delicate profile.

5.3. Invalidated Authenticity & Zero Responsibility Any fragrance purchased unsealed, decanted, or re-bottled from third-party individuals is categorically unrecognized by Scentorium. We cannot guarantee its concentration, purity, or provenance. Scentorium assumes absolutely no responsibility for health reactions, quality issues, or olfactory misrepresentation arising from decanted products acquired outside our official gallery.

SECTION 6. AUTHENTICITY & INTELLECTUAL PROPERTY

6.1. The Guarantee of Provenance Scentorium guarantees that all perfumes in our gallery are 100% authentic and original, sourced exclusively through direct, legal, and authorized channels from the master perfumers and global Perfume Houses.

6.2. Intellectual Property Rights All content within the Scentorium sanctuary—including trademarks, narrative text, bespoke imagery, and site design—is legally protected. Unauthorized use, scraping, or commercial reproduction of our creative assets is strictly prohibited and will be met with immediate legal action.

SECTION 7. DISPUTE RESOLUTION & LEGAL REMEDIES

7.1. Amicable Settlement We believe in the power of refined communication. Any dissatisfaction should first be addressed through our digital concierge at contact@scentorium.eu for a swift and discreet resolution.

7.2. Dispute Resolution Platforms If an agreement cannot be reached amicably, consumers may resort to Alternative Dispute Resolution procedures via the National Consumer Protection Authority (ANPC).
